Robert Nozick – Libertarian Critique of Rawls

1️⃣ INTRODUCTION
Robert Nozick (1938–2002), in his book Anarchy, State and Utopia (1974), presented a libertarian critique of John Rawls.
While Rawls defends distributive justice, Nozick defends individual liberty and property rights.
2️⃣ CORE IDEA – MINIMAL STATE
Nozick argues for a Minimal State (Night-watchman State).
- State should protect life
- Protect property
- Enforce contracts
- No welfare redistribution
Anything beyond this violates individual liberty.
3️⃣ ENTITLEMENT THEORY OF JUSTICE
Justice depends on how property is acquired.
Nozick proposes three principles:
- Justice in Acquisition – Property acquired fairly
- Justice in Transfer – Voluntary exchange
- Rectification – Correction of past injustice
If these are satisfied → distribution is just.
4️⃣ CRITIQUE OF RAWLS
🔹 Against Difference Principle
Rawls says inequality is justified if it benefits the least advantaged.
Nozick says: Redistribution is forced labour.
Taxation = Violation of liberty.
🔹 Against Patterned Theories
Rawls proposes a patterned distribution.
Nozick argues: Any patterned distribution destroys freedom.
Example: If people voluntarily give money to a basketball player, redistribution violates free choice.
