The Governor is the constitutional head of the state, appointed by the President under Article 153 of the Indian Constitution. The office is designed to function as a vital link between the Union and the State, ensuring constitutional governance.
The Governor performs executive, legislative, and discretionary functions. Executive powers are exercised on the advice of the Council of Ministers, while legislative powers include summoning the legislature and reserving bills for Presidential consideration. Discretionary powers arise in situations such as government formation or recommending President’s Rule under Article 356.
While the office serves as a safeguard of constitutional stability, it has often been criticized for political misuse. Allegations of partisan behavior in government formation, delays in assent to bills, and frequent use of Article 356 have generated controversy.
Committees such as the Sarkaria and Punchhi Commissions have recommended reforms, including fixed tenure and non-partisan appointments, to strengthen federal balance.
The challenge lies in ensuring that the Governor acts as an impartial constitutional guardian rather than a political agent.
