1️⃣ What are Rights?

Rights are justified claims that individuals possess against the state or society.

They protect liberty, dignity and autonomy of individuals.

Without rights, democracy becomes majoritarian rule.


2️⃣ Natural Rights Theory

Key Thinkers: John Locke, Hobbes, Rousseau

  • Rights exist in state of nature
  • Inherent and inalienable
  • Life, Liberty and Property (Locke)

State is formed to protect natural rights.

Criticism:

  • What is the source of "natural"?
  • Abstract and philosophical


3️⃣ Legal / Positivist Theory

Rights are created and guaranteed by the state.

  • Without law, no rights
  • Rights depend on constitutional framework

Criticism:

  • State can also violate rights
  • Too state-centric


4️⃣ Marxist Critique of Rights

Marx called liberal rights “bourgeois rights.”

  • Focus on individual, not community
  • Protect private property
  • Mask economic inequality

Political equality without economic equality is incomplete.


5️⃣ Feminist Critique

Rights discourse historically male-dominated.

  • Public/private divide hides domestic oppression
  • Formal equality ≠ Substantive equality
  • Need gender-just rights

Introduces concept of intersectionality.


6️⃣ Human Rights

Universal rights belonging to all human beings.

  • Universal Declaration of Human Rights (1948)
  • Civil and political rights
  • Economic, social and cultural rights

Debate:

  • Universalism vs Cultural relativism
